This dispute presents the increasingly prevalent and pressing question of who is responsible for a charter school’s past failure to provide a Free Appropriate Public Education (“FAPE”) to children with disabilities under the Individuals with Disabilities Education Act (“IDEA”) when the charter school has closed its doors. Plaintiffs are three children (“Students”) with disabilities under the IDEA and their parents (“Parents”) (collectively with Students, “Plaintiffs”).
