[1] This appeal arises out of a declaratory judgment action involving a commercial general liability insurance policy issued by Scottsdale Insurance Company ("Scottsdale"). The issue in the declaratory action that is relevant to the present appeal is whether the Scottsdale policy provided coverage for the claims of Andrew C. Smith and Heather Smith (together, "the Smiths"). The trial court entered an order granting summary judgment in favor of Scottsdale, finding that the Smiths' claims were not covered under the Scottsdale policy.
