DUFFY, Circuit Judge.

This suit was brought by the Secretary of Labor under section 17 of the Fair Labor Standards Act of 1938 (as amended 29 U.S.C.A. § 201 et seq.) to restrain defendant from violating the Act’s overtime provisions with respect to eeiffain truck drivers in its employ (29 U.S.C.A. § 207).

The case was submitted upon a stipulation of facts. The District Court held the Interstate Commerce Commission has the power, under section 204 (a) (3) of the Motor Carrier Act, 1935, 49 U.S.C.A. § 304(a) (3), to fix qualifications and maximum hours of employment for all of defendant’s scrap…
