In May of 2009, the plaintiff, Sherry-Ann Baum (“Baum”), brought an action against Norfolk & Dedham Insurance Co. (“Norfolk”) seeking damages, costs, interest, and attorney’s fees pursuant to G.L.c. 90, §34M, c. 93A, and c. 176D, all based on Norfolk’s failure to pay her personal injury protection (“PIP”) benefits claim arising out of an accident in which she was injured as a pedestrian. Norfolk was the PIP insurer of the automobile involved in the accident. Early in 2010, a motion for summary judgment filed by Norfolk was heard and denied.
