This cause is on appeal after a dismissal of an indictment against the defendant, Beverly Delaney, by the trial judge for prosecutorial misconduct.

The defendant was indicted on two counts of bribery and one count of perjury in a 46-count indictment that was the result of an investigation into alleged misconduct by the Madison County supervisor of assessments.
