Plaintiff William H. McGee & Co. (“McGee”), the insurer of the manufacturer of four machines, sued several shipping companies for damage to the machines while in transit from South Korea to New York. Defendant Kenney Transport, Inc. (“Kenney USA”) was dismissed, and McGee filed an amended complaint adding a new defendant, Kenney Transport (Korea) Ltd. (“Kenney Korea”).…
