THE petition of the plaintiff stated the decree in, this cause, (vide vol. 2. p. 565.) of the 30th of September last, by which the defendant was decreed to pay to the plaintiffs 81,836 dollars, 37 cents, with interest and costs. That on the 17th of October last, the defendant filed an appeal from that decree to the Court for the Correction of Errors, &c.

The first point has been repeatedly decided in favour of the power of this court; and for this purpose, I refer to the case of Eden v. Winter, decided in 1814, (1 Johns. Ch. Rep. 77.) to Bradwell v.
