This is an action' of assumpsit brought in the superior court of Cook county by Arthur W. Whitcomb against the Butterick Publishing Company to recover damages for a wrongful discharge on a contract of hiring. The declaration set out the contract in legal effect in the first count and in hcec verba in the second, and averred a wrongful discharge. .The only plea filed was non-assumpsit, and a trial by jury was had resulting in a verdict in favor of plaintiff . below of $3940, upon which the court rendered judgment after overruling motions for a new trial and in arrest of judgment.
