This was an action of ejectment, instituted in the Circuit Court of Hancock county, 1859, to recover the north-west quarter of Section 26, Township 5 north, Range 8 west, of the fourth principal meridian. On the trial the parties waived a jury, and submitted the " case to the court, and thereupon the defendant admitted that he was in possession of the premises in controversy, at the time of the commencement of this suit, March 7, 1859. Breeden brought his action of ejectment against Dickenson to recover possession of the north-west quarter of Section twenty-six, in Township five north, Range eight west, in Hancock county. The issue was tried by the court without a jury, and a verdict and judgment for the plaintiff, from which the defendant appeals to this court.
Both parties claim title from the same source, the plaintiff by deed from the original patentee, the defendant by deed executed by his heirs-at-law, and he also claims color of title made in good faith, and payment of taxes for seven successive years thereunder, as a…
