This is an appeal from a summary judgment in favor of appellee, Donald R. Heck-erman, defendant below, in a suit brought by appellant, American Motors Acceptance Corporation, plaintiff below. In the briefs filed herein, appellant is referred to as plaintiff, and the appellee as defendant. For purposes of clarity, the parties will be referred to in the same manner in this opinion.
