This suit was brought by appellee to recover damages for injury to his property alleged to have been caused by the construction and operation by appellant of its railroad over and along its right of way and across Bolton Street in the town of Jacksonville, in Cherokee County, said right of way and street being adjacent to appellee’s property. By agreement of the parties and with the consent of the judge the case was set for trial in the court below on Thursday of the second week of the term of court.
