Architectural Testing, Inc. (Employer) petitions for review of an order of the Unemployment Compensation Board of Review (Board) reversing the decision of an Unemployment Compensation (UC) Referee (Referee) which denied benefits to George W. Yohe, II (Claimant) under Section 402(e.1) of the Unemployment Compensation Law (Law).1 Employer argues that the Board misconstrued Section 402(e.l) of the Law, which relates to a claimant’s ineligibility for benefits “due to failure to submit and/or pass a drug test conducted pursuant to an employer’s established substance…
