Error to a judgment of the Circuit Court of Albemarle county in an action of trespass on the case. Judgment for plaintiffs. Defendants assign error.

These are two cases that by agreement of parties were heard and determined together, the same jury rendering a verdict in each case. The plaintiffs (defendants in error in this court), severally sued the Southern Railway Company for damages caused them by the backed up flood waters of the Hardware river. The backing up- of these waters was alleged to be due to the inadequacy of a culvert of the defendant company, constructed across the said water course.
