KNight, Justice.

At the general election, held in 1896, plaintiff was candidate for the office of county treasurer of Carbon County. The returns of the election as canvassed gave him twenty-seven votes less than Fred M. Baker, the opposing candidate, and a certificate of election was issued to said Baker, under which he duly qualified and assumed the duties of said office.
