The plaintiff Metropolitan Life Insurance Company and defendant Union Trust Company entered into a written agreement entitled: “ Contract with Mortgage Loan Correspondent ’ ’ dated January 28, 1929, wherein it was agreed that the said Union Trust Company “ shall act as correspondent for the Company in -the City of Rochester, State of New York, for the purpose of submitting loans secured by mortgages or deeds of trust for sale to the Company.” During a period of about eighteen months following the making of this agreement the plaintiff purchased from the Trust Company as such mortgage loan…
