The petitioner is one of five persons duly nominated for the office of justice of the Supreme Court by the Republican judicial district convention for the first district. The last day for filing the certificate of nomination was October 3, 1933, being the fifth Tuesday preceding the general election (Election Law, § 140, subd. 5).
