Plaintiff, a person of full age, on May 14, 1904, made written application to the defendant, an insurance corporation organized and existing under and by virtue of the laws of the State of New York, having its principal office and place of business in the city, county and State of New York, and duly authorized to conduct the business of life insurance therein, for insurance on his life, and on the same day the defendant issued five identical policies, known as insurance and investment policies, to plaintiff.
