This action was brought, pursuant to the provisions of section 109 of the Insurance Law, upon an automobile liability policy issued by the defendant to Zion Funeral Parlors, Inc. The policy was dated February 10, 1930, and thereby the defendant purported to insure Zion Funeral Parlors, Inc., for a period of three months, beginning at noon on February 10, 1930, and ending at noon on May 10, 1930.
