The defendants in this case having been convicted of murder, gave notice of appeal upon the several grounds set out in the record, but having escaped from jail pending the appeal, and only one of them, to wit, the defendant, Murrell, having been recaptured, his appeal alone will be considered; as this court declines to hear the appeal of a party who evades the process of the court, and refuses to submit himself to its jurisdiction.
