This action is before the court on plaintiffs motion for summary judgment and defendant’s motion for partial dismissal and cross-motion for summary judgment. Plaintiff, a retired Deputy United States Marshal, seeks judgment against defendant *195in the form of a court order declaring illegal defendant’s refusal to calculate plaintiff’s retirement benefits and related emoluments upon a basis which includes Administratively Uncontrollable Overtime (AUO) during his last three years of employment, and awarding plaintiff damages for his resulting monetary losses.
