MEMORANDUM OPINION

ALBRITTON, District Judge.

I. Introduction

The United States of America (“the Government”) filed this civil action in rem for forfeiture of Claimant George T. Jenkins’ (“Jenkins”) real property, which includes a grocery store, located at 427 and 429 Hall Street, Montgomery, Alabama on October 29, 1991. 1 It seeks forfeiture pursuant to the Comprehensive Drug Abuse Prevention and Control Act of 1970, 21 U.S.C. § 881(a)(7).
