STORY, Circuit Justice.

It is not necessary,' in this stage of the cause, to inquire info the exactness or regularity of the allegations of the parties. A preliminary question, as to the right of this court to adjudicate upon the merits, of the case, has been brought forward upon a protest to its jurisdiction, and after an ample discussion, remains now to be decided.

The question in short is this, whether the courts of the United States, in the exercise of their authority over causes of admiralty and maidtime jurisdiction, have cognizance of maritime suits in rem between foreigners, whose…
