I. STATEMENT OF FACTS AND PROCEDURAL HISTORY
On August 21, 2001, plaintiffs, Joseph M. Leonard and Lois Leonard, individually and as husband and wife, filed a complaint seeking to recover damages for inju*168lies sustained as a result of an automobile accident which occurred on August 28, 1999.
