LATTIMORE, Judge.

— Appellant was convicted in the' District Court of Bell county of the offense of burglary, and his punishment fixed at confinement in the penitentiary for a period of two years.

That a store in the care, management and control of H. T. Cochran in Bell county, Texas, was entered at night in such manner as to constitute burglary, seems undisputed in this record.
