SIBUEY, District Judge.

The return to the writ showed the applicant held in the United States penitentiary, Atlanta, Ga., since May 2, 1919, under sentence by a court-martial. The exhibited record shows the arraignment and trial of Capt. William J. Givins, Infantry, United States Army, on October 30, 1918, before a general court-martial convened at Camp Sevier, S. C., under Special Order No. 172, Headquarters, Camp Sevier, S. C., on a violation of the Ninety-Second Article of War (Comp.
