Ilolcraft sued King and others for an alleged trespass upon his land.

*353The complaint contained three paragraphs. The first alleges that the defendants, on the 3d day of March, 1864, and at divers other times since then, and before the commencement of the suit, maliciously, ,&c., and falsely pretending that the plaintiff was obstructing a public highway, and claiming the right to remove such obstruction, with force and arms unlawfully entered upon the plaintiff’s premises, which are described, and then and there unlawfully, &c., tore down and destroyed a large amount of fencing and other…
