MEMORANDUM OPINION AND ORDER
JOYCE HENS GREEN, District Judge.
Presently pending are the parties’ cross-motions for summary judgment. The plaintiff, Lynwood M. Guy (“Guy”), has filed suit against the Secretary of Agriculture (“Secretary”) contending that defendant’s final administrative decisions on April 10, 1994, (for crop year 1993) and June 1, 1995, (for crop year 1994) were arbitrary and capricious and not in accordance with law.
