ORDER ON CROSS MOTIONS FOR SUMMARY JUDGMENT

NESBITT, District Judge.

This cause is before the court upon the Cross Motions for Summary Judgment filed by the parties. This is an action for forfeiture in rem of real property pursuant to 21 U.S.C. § 881(b) and 28 U.S.C. §§ 1355 and 2461. One of the claimants to the Defendant property, ALLEGHENY MUTUAL CASUALTY COMPANY (ALLEGHENY), filed a claim of ownership interest and an answer seeking a determination as to the priority of its claim for the sum of $100,000 together with interest, court costs and legal fees.
