My views are at variance with those of my colleagues as to the proper disposition of this case. The following is a statement of their opinion: “Under the facts of this case the insurance policy sued on had become absolutely null and void at the time of decedent’s death. It is conceded that the loan on the policy, with the accrued interest thereon, had exhausted every particle of its cash value.
