GURFEIN, District Judge.
The plaintiff which uses the trademark “The Geo. Washington Mint” moves to enjoin, pendente lite, the defendant which uses the trademark “The Washington Mint.” The defendant also uses as its mint mark on the reverse side of its products, in conjunction with “The Washington Mint,” a representation of the Washington Monument and a profile of George Washington. Both claim use in interstate commerce. Each claims prior use. Neither party has registered its mark under the Lanham Act, 15 U.S.C. § 1051 et seq., although the plaintiff has applied for registration. The plaintiff…
