The defendant city denied plaintiff Darks a license to operate a dance hall 1 because Darks had two felony convictions. Darks sued the city claiming he had been discriminated against on the basis of race in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq., and 42 U.S.C. §§ 1981 & 1983; and that the city’s licensing policy deprived Darks of equal protection and due process of law.
