Prom á conviction of murder in the second degree and fixing his punishment at ten years’ imprisonment in the penitentiary, under an information filed by the prosecuting attorney of Monroe county in the circuit clerk’s office of said county, charging defendant with murder in the first degree in shooting and killing with a pistol one Bob Stoneking at said county. *719on the twenty-first day of December, 1901, defendant appeals.
