Plaintiffs, Sharon Smith McLaurin, Cottrell McLaurin, and Toni Lewis Kelly, bring this action against defendant, Waffle House, Inc., for discrimination in public accommodation based on race in violation of Title II. of the Civil Rights Act of 1964, 42 U.S.C. §.2000a (“Title II”); for false imprisonment, intentional infliction of emotional. distress, negligent hiring, supervision, training and retention, assault and battery under state law; and declaratory relief under federal and state law.1 Plaintiffs seek a declaration of…
