Pending before this Court are cross motions for summary judgment. Defendants the Republic of Costa Rica and the Consulate of the Republic of Costa Rica have moved for summary judgment requesting that the Court dismiss the Complaint with prejudice for lack of subject matter jurisdiction. 1 (Docket No. 50).
