BluME, Justice.

C. W. Jeffrey, the defendant and respondent herein, hereinafter called the defendant, was a physician at Rawlins, Wyoming. D. R. Higley is the administrator of the estate of Kathryn Ruth Higley, deceased, and her surviving husband. He will hereafter be referred to as the plaintiff. The defendant, on May 23, 1928, performed an abdominal operation on the deceased on account of protrusion of the uterus, for the removal of the appendix, and other purposes.
