In an action to recover damages for personal injuries, etc., brought under the Jones Act (46 USC § 688), the plaintiffs appeal from a judgment of the Supreme Court, Richmond County (Leone, J.), dated November 4, 1989, which, upon a decision by the court that the plaintiff Peter O’Brien was not a "seaman” within the purview of the Jones Act, dismissed the complaint.

Ordered that the judgment is affirmed, with costs.
