Before the court are Defendant J.L. Foti Construction Co., Inc.’s (“Foti”) motion to dismiss and Defendant Donley Inc.’s (“Donley”) motion for partial summary judgment. Plaintiff Donald W. Robinson alleges that Defendants Foti, Donley and N & C Construction Co. (“N & C”) failed to hire him due to his race and in retaliation for his past challenges to allegedly unlawful employment practices.
