Plaintiff appeals from a judgment in favor of defendants. The action is one to recover damages for the death of plaintiff’s intestate while employed in interstate commerce, as a brakeman by the receivers of the Chicago, Milwaukee & St. Paul Eailway Company. There was a verdict for plaintiff. On defendants’ alternative mo tion for judgment notwithstanding the verdict or a new trial, the court granted judgment for the defendants, and this appeal followed.
