This is an action in assumpsit brought by the plaintiff against the defendant, claiming damages for the breach of an alleged oral contract in the amount of $2,000.00 with interest from March 1, 1945. The pleadings consist of the *532plaintiff’s statement of claim and the defendant’s affidavit of defense.

The contract alleged being oral, the allegations of fact contained in the statement of claim are of primary importance and demand careful analysis in order to determine their legal significance. Accordingly they will be set forth and commented upon in detail.
