Action to recover damages for personal injuries alleged to have been caused by the defendant’s negligence, brought to the Superior Court in New Haven County and tried to the jury before Burpee, J.; verdict and judgment for the defendant, and appeal by the plaintiff. The complaint contains two counts, whose allegations are precisely alike save that the first contains one that the plaintiff was employed by the defendant in interstate commerce at the time his injury was received, which was absent from the second. The reasons of appeal challenge the correctness of the trial court’s action in sustaining the demurrers to the motions for a disclosure; but its action in sustaining the demurrer to the motion, as finally amended and perfected, alone calls for consideration.
