delivered the Opinion of the Court.

This is an appeal from a verdict and judgment for the plaintiff in the amount of $7,908.85 entered in the district court at Butte, the Honorable James Freeboum, district judge, presiding with a jury.

The action arises out of injuries sustained by the plaintiff, Mrs. Carol Pushard, when she fell inside of the store of the defendant, J. C. Penney Co., Inc., at about 10:45 AM., February 17, 1966.
