Plaintiff Techno-Comp, Inc. (“Techno-Comp”) filed this action on September 9, 2014, invoking the Court’s diversity jurisdiction to recover monies from Defendant Anthony Arcabascio. Currently before the Court are (1) defendant’s motion to dismiss pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure, and (2) plaintiffs cross-motion seeking leave to amend the complaint.
