In this case L. C. Jones Trucking Company, Inc., a corporation, brought an action on March 8, 1949 against Jo E. Fletcher and John B. Shaw, doing business as Fletcher and Shaw, defendants, to recover judgment of $5667.45 on a note dated February 11, 1949 executed by “Fletcher & Shaw, Jo E. Fletcher.” That will hereafter be referred to as the “main case.” The Superior Oil Company was served with garnishment process and it answered on April 1, 1949 that it owed the defendants the sum of $7868.00.
