SOPER, Circuit Judge.

Paul A. Smith, herein referred to as plaintiff, was severely burned by indirect contact with a high-voltage electric wire owned and operated by the Appalachian Electric Power Company, and brought suit against the company, herein referred to as defendant, to recover damages in the amount of $150,000. The suit, brought originally in the circuit court of Kanawha county, W. Va., was removed to the District Court because of diversity of citizenship and was there tried.
