McDADE, District Judge.

Before the Court is a Report and Recommendation from United States Magistrate Judge Robert J. Kauffman [Doe. #9] that Defendant’s Motion to Dismiss [Doc. # 5] be granted. Plaintiff has objected to the Report and Recommendation; therefore, pursuant to 28 U.S.C. § 636(b)(1), the Court shall make a de novo review of those portions of the recommendation to which objections were made.
