This suit was brought by the respondent in the circuit court for Benton county, to enjoin the sheriff of said county from levying an execution on certain lands purchased by respondent at an execution sale. The facts are, that on the 4th day of February, 1873, the appellants, Leeds, Palmer & Co., recovered •a judgment against Simeon Bethers. On the 9th day of November, 1876, the respondent also recovered a judgment against said Bethers.
