HARRINGTON, District Judge.

This matter is before the Court on a motion for summary judgment brought by Defendant International Organization of Masters, Mates, and Pilots, AFL — CIO (“MMP”). The plaintiff brings this hybrid action pursuant to Section 301 of the Labor Management Relations Act, 29 U.S.C. § 185. Plaintiff argues that the failure of MMP to arbitrate his post-termination grievance was arbitrary, capricious, and in bad faith, and therefore constitutes a breach of duty of fair representation under the Act.
