Statement op Facts.
On December 11, 1940, at about 9:30 p. m., Dan Eagan killed his wife, Catherine, by shooting her through the neck with a revolver. The place of the homicide was in the basement apartment occupied by the couple at 231 West 12th St., Casper, Wyoming, the house owned by defendant’s mother, and the main floor of which was occupied by her. The time was fixed with reasonable certainty, as a physician was upon the scene while the deceased was still living, and she died in his presence. The State charged Eagan with first degree murder.
