Respondent Fluoroware, Inc. (Fluoroware) brought this declaratory judgment action against Chubb Group of Insurance Companies (Chubb), Crum & Forster Insurance Organizations (Crum & Forster), Great Northern Insurance Company (Great Northern), and United States Fire Insurance Company (U.S. Fire), seeking a declaration that said insurance companies were obligated to defend and indemnify respondent against a patent infringement suit brought by Empak, Inc.
