MEMORANDUM OPINION (Defendant’s Motions to Dismiss Su-perceding Indictment)

HUDSON, District Judge.

This matter is before the Court on Defendant Dwight Edwin Whorley’s Motion to Dismiss Superceding Indictment and Motion to Dismiss Counts of Superceding Indictment for Failure to Allege an Offense. Both sides have submitted memo-randa in support of their respective positions and this Court heard oral argument on August 3, 2005.
